Sick Leave Bank

The purpose of the sick leave bank is to provide a source of sick leave for a district employee who sustains a long illness and uses up all accumulated leave or for the new employee who likewise sustains a long illness and does not have accumulated leave to use. The sick leave bank will consider all illnesses, including medical conditions related to pregnancy.

All employees may participate in one of two sick leave banks. Licensed employees may participate in the Licensed Employees’ Sick Leave Bank and all other employees may participate in the Classified Employees’ Sick Leave Bank. Each bank shall consist of a common fund of paid sick days, some of which will be contributed by the Huerfano Re-1 School District and some of which will be contributed by participating employees.

Days shall be available to participating employees under the following conditions:

Membership

Membership in the appropriate sick leave bank shall be voluntary.

1. Requirements for membership

  1. Members must be full or part-time employees. Substitute and temporary employees shall not be eligible to participate.

  1. Employees shall provide the superintendent with written intent to enroll in the sick leave bank as well as the assignment of days they wish to deposit in the bank on or before the final enrollment date set forth by this policy.

  1. Each employee who desires to become a member of the sick leave bank shall, at the time of joining, irrevocably contribute one personally accrued sick leave day. Thereafter, employees shall contribute at least one additional day each year in order to remain a member of the sick leave bank.

  1. Members may contribute additional sick leave days as the needs of the bank dictate.

2. Enrollment dates

  1. Open enrollment shall begin each school year and end October 1.

  1. Employees who begin work after October 1 shall have 30 days from the first day of employment to elect to join the sick leave bank for the current school year.

  1. Employees who elect to join the sick leave bank shall remain members for the duration of their employment unless written notice of withdrawal is given to the superintendent on or before October 1 of any given school year.

3. Withdrawal from membership

Any member may terminate membership in the sick leave bank by giving written notice to the superintendent of the intent to terminate. Termination shall be effective immediately. Upon termination, the terminating member shall forfeit any right to withdraw days from the sick leave bank, including those days contributed by the terminating member up to the date of termination, except as specified in 7.a. below.

Conditions for use of sick bank days

    1. A member must have used all personally accumulated sick leave before being eligible to withdraw any days from the sick leave bank.

    1. Sick leave days can only be withdrawn from the bank because of a member’s personal illness or the illness of an immediate family member.

    1. Withdrawals from the sick leave bank may not be made when a member is eligible for disability benefits, PERA or workers’ compensation insurance benefits.

    1. The actual number of sick leave days any member shall be permitted to withdraw shall be determined by the appropriate sick leave bank committee (Committee). The maximum number of sick leave bank days that can be requested at any one time by participating employees shall be limited to one academic calendar quarter. Subsequent requests may be made. Each request may be granted or denied, in whole or in part.

    1. Requests for withdrawals from the sick leave bank must be made in writing and submitted to the chairperson of the Committee. The request must be accompanied by supporting medical report(s) from the requesting member’s health care provider(s).

    1. Days withdrawn from the sick leave bank shall be treated as paid sick leave for the member using them.

    1. The Committee (with the assistance of the central office staff) shall monitor the total number of available days in the sick leave bank and may assess all members an equal number of days of additional contribution in order to bring the available balance of days to the level deemed appropriate.

  1. Any member shall have the right to terminate membership in the bank within 10 days of the Committee levying any assessment of additional sick days, without that member having to contribute any more of his or her personal sick days to the bank.

  1. Should any member be unable to contribute additional assessed sick leave days, other members of the bank may voluntarily contribute additional days to make up for the shortfall.

Sick leave bank committees

1. Licensed employees sick leave bank committee: This Committee shall consist of:

  1. Four teachers (one from each building) employed by the district who are members of the sick leave bank, and the HEA president.

  1. Each committee member shall serve for a term of two years.

  1. Appointment of teachers to the committee shall be by majority vote of teachers who are members of the sick leave bank. All shall serve without additional compensation.

  1. The Committee shall elect a chairperson annually from among its members.

  1. The Committee shall oversee the operation of the licensed employee sick leave bank, determine the propriety of withdrawals by members and monitor the sick day accrued balance.

2. Classified employees sick leave bank committee: This Committee shall consist of:

  1. Five classified employees who are members of the sick leave bank and one member of the Board of Education. The classified employee members shall include one teacher’s aide, one secretary, one custodian, one cook and one employee from the district’s transportation department. Each department shall choose its own representative by majority vote of the employees in the department who are members of the bank. All shall serve without additional compensation.

  1. Each Committee member shall serve for two years.

  1. The Board member shall be designated by the Board of Education.

  1. The Committee shall elect a chairperson annually from among its members.

  1. The Committee shall oversee the operation of the classified sick leave bank, determine the propriety of withdrawals by members and monitor the sick day accrued balance.

Committee members may serve consecutive terms without limit.
